URGENT notice in respect of Circuit Court Motions, etc in Tipperary, Kilkenny & Wexford
Dear Colleagues
I confirm that all civil motions, family law motions, family law case progressions and civil case progressions before the County Registrar during the month of January sitting in the counties of Tipperary, Kilkenny and Wexford will now be conducted remotely.
Civil Motions, Family Law Motions, Family & Civil Case Progressions
PLEASE NOTE : As of today, the motion and case progression lists scheduled for next Monday in Clonmel (11th January 2021) are now postponed (indeed 75% of the list has already been concluded via email). I would ask any of the practitioners involved in the outstanding matters in these lists to email me directly and I will organise a remote hearing in each case via Zoom. I apologise for any inconvenience caused.
I will now put in place a remote hearing system for civil and family law motions and I will be in touch with you shortly with details of how to access the remote hearing of the motion lists. I hope to conduct the next list (Kilkenny Wednesday 13th January 2021) remotely and will be in touch with you early next week.
In the meantime, where the parties have agreed to adjourn a motion or a case progression, or where the parties have agreed terms of a motion or case progression, I direct that they should email me directly at jamesseymour@courts.ie and I will make the necessary order without the need for the parties to attend at court. Where any civil case has settled, the parties should email me directly and I can make the necessary order (where allowed under the Rules of the Circuit Court).
Where the parties agree, all case progressions can be scheduled for remote hearing and again, the parties should email me directly requesting a remote hearing and I will organise same.
Taxations
All taxations will continue to be heard remotely.
Certain applications to be dealt with in the office/remotely
Where one of the following applications is lodged, I will review the papers and where the proofs are in order, I will make the necessary order without the need for the parties to appear in court:
- applications for the appointment of a care representative
- applications for a marriage exemption
- applications for an order for substituted service
- applications for a conditional order of garnishee/appointment of a receiver (the subsequent application to make a conditional order absolute must be heard in court)
- ex parte applications to substitute the plaintiff
